These Terms of Service (the “Terms”) are a legal agreement between you and Rigoberto Lopez, doing business as Travel Space (“Travel Space,” “we,” “us,” or “our”). Travel Space operates travelspace.shop and the related online storefront, customer-account features, order services, communications, and other services that link to these Terms (collectively, the “Services”).
Please read these Terms carefully. By checking a box or otherwise indicating acceptance when that option is presented, placing an order through the Services, creating an account, or continuing to use the Services after receiving reasonable notice of these Terms, you agree to be bound by them. If you do not agree, do not use the Services or place an order.
1. Related Policies
The following policies are incorporated into these Terms by reference:
Additional product-specific terms, promotion terms, warranty terms, instructions, or notices displayed before purchase may also apply.
If these Terms conflict with a more specific published policy regarding its subject matter, the more specific policy controls to the extent of the conflict. Mandatory law always controls over a conflicting contractual provision.
2. Eligibility and Authority
You must be at least 18 years old or the age of legal majority where you live, whichever is higher, to place an order or create an account without the involvement of a parent or legal guardian.
By using the Services, you represent that:
- You have legal capacity to enter into these Terms.
- The information you provide is accurate and complete.
- You will use the Services only for lawful purposes.
- You are not prohibited by applicable law from receiving the products or Services.
If you use the Services on behalf of a business or another person, you represent that you are authorized to bind that business or person to these Terms.
3. Changes to These Terms
We may update these Terms to reflect changes in the Services, products, operations, technology, policies, or legal requirements. The revised Terms will be posted on travelspace.shop with a new “Last updated” date.
Material changes generally apply prospectively. Unless required by law or expressly agreed, a change will not retroactively alter the purchase terms that governed an order already placed.
When required, we may provide additional notice by email, account message, website banner, or another reasonable method. Continued use of the Services after the effective date of revised Terms constitutes acceptance only to the extent permitted by law and after legally sufficient notice.
4. Limited Permission to Use the Services
Subject to these Terms, Travel Space grants you a limited, personal, revocable, non-exclusive, non-transferable right to access and use the Services for lawful shopping, account management, customer support, and other intended purposes.
This permission does not transfer ownership of the Services or any content. You may not use the Services in a way that infringes our rights or the rights of another person.
5. Customer Accounts
If customer accounts are available, you are responsible for:
- Providing accurate account information.
- Keeping login credentials confidential.
- Restricting access to your device and account.
- Promptly notifying us of suspected unauthorized access.
- All activity conducted through your account to the extent permitted by law.
Do not share credentials or impersonate another person. We may require reasonable verification before disclosing account information, changing an address, or processing a sensitive request.
We may suspend or restrict an account when reasonably necessary to investigate fraud, unauthorized access, abuse, security risks, or violations of these Terms. We will not use an account suspension to avoid valid order, refund, privacy, or consumer-law obligations.
6. Product Information
We aim to describe and display products accurately. Product pages may include photographs, dimensions, materials, colors, features, package contents, usage information, availability, and other details.
However:
- Colors and appearance may vary because of lighting, photography, manufacturing variation, and device-display settings.
- Measurements may have reasonable manufacturing or measuring tolerances.
- Packaging, labels, or minor non-material details may change without notice.
- A product image may include props or items not included in the purchase; the written product description and package-contents statement control.
We will not knowingly substitute a materially different product without your agreement. If a product received is damaged, defective, incorrect, incomplete, or materially different from its description, contact us under the Refund and Return Policy.
7. Product Use, Instructions, and Safety
You are responsible for reading and following all product descriptions, instructions, labels, warnings, weight limits, maintenance guidance, and safety information.
Travel Space products are intended for ordinary travel organization, packing, or storage only as described on the applicable product page. Unless expressly stated otherwise, they are not designed for medical, protective, life-safety, hazardous-material, industrial, or food-storage use.
Important general precautions include:
- Keep plastic bags, packaging, small parts, pumps, valves, straps, and similar items away from babies, children, and pets when they could create a suffocation, choking, entanglement, or injury risk.
- Inspect a product before use and stop using it if it is torn, cracked, damaged, leaking, or otherwise unsafe.
- Do not exceed stated size, weight, compression, temperature, pressure, or use limits.
- Do not use a product in a manner inconsistent with its instructions or intended purpose.
- Protect fragile, sharp, valuable, liquid, perishable, or sensitive contents appropriately.
Travel products do not guarantee that baggage will satisfy an airline, transportation provider, hotel, venue, or security rule. You remain responsible for baggage size, weight, contents, fees, prohibited-item rules, and other requirements imposed by third parties.
Nothing in this section excludes liability or product remedies that cannot legally be excluded.
8. Orders and Contract Formation
Submitting an order is an offer to purchase the products in the cart under the prices, shipping terms, policies, and other information displayed before submission.
An automated order confirmation acknowledges that we received the order. It does not necessarily mean that we have accepted the order or that every product is available.
Unless applicable law provides otherwise, we accept an order when we send a shipping confirmation, expressly confirm acceptance, or otherwise begin final fulfillment. We may decline or cancel an order before acceptance for a legitimate reason, including:
- Product unavailability.
- An obvious pricing, description, or system error.
- Inability to verify payment or shipping information.
- Reasonable evidence of fraud, unauthorized activity, resale abuse, or prohibited conduct.
- A shipping restriction or inability to serve the submitted address.
- A legal, regulatory, safety, recall, or sanctions restriction.
If we cancel an order after payment has been authorized or collected, we will void the authorization or issue the refund required by applicable law. We will explain the cancellation when reasonably possible, except when doing so would compromise security, fraud prevention, or a legal obligation.
9. Product Availability and Quantity Limits
All products are subject to availability. Placing an item in a cart does not reserve it.
We may establish reasonable quantity limits per product, order, customer, household, account, payment method, address, or promotion. We may reduce or cancel quantities when reasonably necessary to prevent fraud, inventory depletion, unauthorized resale, promotion abuse, or a system error.
Any limitation will be applied consistently with applicable law. If only part of an order can be fulfilled, we may contact you, ship the available items, or cancel the unavailable items and issue the appropriate refund.
10. Prices, Taxes, and Promotions
Prices are displayed in the currency shown on the website or at checkout and may change before an order is submitted. A price change does not affect an order already accepted, except where applicable law permits correction of an obvious error.
Applicable sales tax and shipping charges are calculated or displayed before purchase. You are responsible for charges clearly disclosed and accepted at checkout.
Discount codes, gifts, bundles, free-shipping offers, and other promotions:
- Apply only during the stated period and while supplies last.
- May have product, customer, geographic, quantity, or minimum-purchase restrictions.
- Cannot be combined unless expressly stated.
- Have no cash value and cannot be sold or transferred unless expressly permitted.
- May be canceled or corrected when affected by fraud, abuse, or an obvious technical error.
We will not apply undisclosed charges after an order is placed.
11. Payments
Payment methods available at checkout may be provided by Shopify, card networks, banks, digital-wallet providers, or other third-party payment services.
By submitting payment information, you represent that:
- You are authorized to use the selected payment method.
- The billing information is accurate.
- You authorize the applicable amount, including disclosed taxes and shipping charges, to be charged or reserved.
A payment provider may place an authorization hold, conduct fraud screening, request verification, decline a transaction, or apply its own terms. Travel Space generally does not receive or store complete payment-card numbers or card security codes.
If a payment is reversed, disputed, unauthorized, declined, or not completed, we may pause or cancel fulfillment while preserving all rights and remedies available to you under law. Contact support@travelspace.shop if you believe a charge is incorrect. Nothing in these Terms limits a lawful right to dispute a charge with your payment provider.
12. Shipping and Delivery
Our current processing time, destinations, rates, estimated transit times, tracking procedures, delay practices, and delivery-issue procedures are stated in the Shipping Policy.
Shipping and delivery estimates are not guaranteed unless expressly identified as guaranteed. We must nevertheless have a reasonable basis for shipment representations and will provide delay notices, cancellation options, and refunds when required by applicable law.
Products may be processed and shipped by third-party suppliers, fulfillment services, warehouses, and carriers. Travel Space remains responsible for its obligations as the seller even when a third party performs part of fulfillment or delivery.
13. Returns, Replacements, and Refunds
Returns, replacements, exchanges, damaged or incorrect items, refund methods, refund timing, and the seven-calendar-day voluntary return window are governed by our Refund and Return Policy.
The voluntary return window does not eliminate any longer or additional remedy that cannot legally be limited, including rights concerning defective, misdescribed, unsafe, unshipped, or undelivered merchandise.
14. Cancellations and Order Changes
Contact support@travelspace.shop promptly to request an order cancellation, address correction, product change, or shipping-method change.
We will make a reasonable effort to accommodate a request before fulfillment begins, but changes are not guaranteed after processing starts. The Shipping Policy and Refund and Return Policy govern requests made after shipment.
This section does not restrict a cancellation or refund right arising from a shipping delay, inability to fulfill, unauthorized transaction, or other protected circumstance.
15. Errors, Inaccuracies, and Corrections
The Services may occasionally contain typographical errors, inaccurate information, broken links, inventory discrepancies, or omissions concerning product descriptions, prices, promotions, shipping, availability, or other content.
We may correct an error and update the Services at any time. If a correction materially affects an order before acceptance, we may contact you for confirmation or cancel and refund the affected order.
We will not rely on this section to avoid honoring a reasonable customer expectation created by a non-obvious error after an order has been accepted when applicable law requires otherwise.
16. Prohibited Uses
You may not use the Services to:
- Violate a law, regulation, court order, or third-party right.
- Commit or facilitate fraud, theft, payment abuse, identity misuse, or other unlawful conduct.
- Submit false, misleading, or impersonating information.
- Upload malware, malicious code, or content intended to damage or disrupt systems.
- Probe, scan, test, bypass, or interfere with security, authentication, access controls, or rate limits.
- Access data, accounts, or portions of the Services without authorization.
- Scrape, crawl, copy, harvest, or use automated means against the Services except as allowed by law, standard search-engine indexing, or our written permission.
- Reverse engineer, decompile, disassemble, or attempt to derive source code except where a restriction is prohibited by law.
- Interfere with another person’s use of the Services.
- Send spam, deceptive messages, or unauthorized promotions through the Services.
- Purchase products for unlawful use or in violation of an applicable restriction.
- Misuse promotions, returns, refunds, chargebacks, reviews, or customer-support processes.
- Infringe intellectual-property, privacy, publicity, or other rights.
We may investigate suspected violations and preserve or disclose information where permitted or required by law.
17. Third-Party Services and Links
The Services are hosted on Shopify and may integrate payment, analytics, advertising, communication, review, fraud-prevention, fulfillment, tracking, social-media, and other third-party services.
Third-party services may have their own terms and privacy policies. Travel Space is not responsible for the independent content, security, availability, or conduct of an unaffiliated third-party website or service, except to the extent applicable law provides otherwise.
A link or integration does not necessarily imply endorsement. Review third-party terms before using an optional third-party feature. This section does not reduce Travel Space’s responsibility for selecting and using service providers in connection with our own obligations to customers.
18. Reviews and Other User Content
The Services may allow you to submit reviews, ratings, photographs, videos, comments, questions, messages, or other content (“User Content”).
You retain ownership of your original User Content. By submitting it to a public or promotional feature of the Services, you grant Travel Space a non-exclusive, worldwide, royalty-free, sublicensable license to host, reproduce, format, translate, publish, display, distribute, and use that User Content in connection with operating, improving, advertising, and promoting Travel Space and the products, subject to applicable law and our Privacy Policy.
This license does not transfer ownership of your User Content and does not prohibit you from using it elsewhere.
You represent that:
- You created the User Content or have permission to submit it.
- It is based on your genuine experience when presented as a review or testimonial.
- It is not knowingly false, deceptive, defamatory, threatening, obscene, unlawful, or infringing.
- You disclose any material incentive, gift, payment, employment, family, or business relationship when required.
- It does not contain another person’s sensitive or private information without permission.
We may moderate or remove User Content for legitimate reasons, including illegality, threats, harassment, personal data, spam, irrelevance, fraud, conflicts of interest, intellectual-property infringement, or violation of these Terms. We will not prohibit, penalize, or demand ownership of an honest consumer review merely because it is negative.
We may identify incentivized content or decline to publish it when needed to preserve review integrity or comply with law.
19. Feedback and Suggestions
If you voluntarily provide an idea, suggestion, improvement, or other feedback that is not submitted as a customer review or confidential business proposal, you grant us permission to use it without restriction or compensation, subject to applicable law.
Do not submit confidential information through a general feedback channel. This section does not transfer ownership of your honest review or override the User Content section.
20. Intellectual Property
The Services and their original content, including the Travel Space name, logos, branding, website design, text, graphics, product photography owned by us, videos, software, and arrangement of materials, are owned by or licensed to Travel Space and are protected by intellectual-property laws.
Except for the limited permission expressly granted in these Terms, you may not reproduce, modify, distribute, sell, license, publicly display, create derivative works from, or commercially exploit our protected content without prior written permission.
Third-party names, logos, product marks, photographs, and content remain the property of their respective owners. Their appearance does not transfer ownership or necessarily imply endorsement.
If you believe content on the Services infringes your intellectual-property rights, contact support@travelspace.shop with sufficient information to identify the work, the allegedly infringing material, its location, your contact details, and the basis for your claim. We may request additional information reasonably necessary to evaluate the notice.
21. Privacy
Our collection, use, disclosure, retention, and protection of personal information are described in the Privacy Policy.
By using the Services, you acknowledge that information may be processed by Shopify and other service providers as described in that policy. Privacy choices and legal rights remain governed by applicable law and the Privacy Policy.
22. Electronic Communications
By placing an order or contacting us electronically, you consent to receive transactional communications relating to the order, account, security, customer support, shipping, returns, refunds, and policy updates.
Marketing email or text messages are separate and are sent only as permitted by law and your choices. You may unsubscribe from marketing without affecting necessary transactional messages.
To the extent permitted by law, electronic records, notices, confirmations, and acceptances satisfy requirements that communications be in writing. You are responsible for maintaining a current email address and for reviewing messages reasonably sent to it.
23. Suspension and Termination
You may stop using the Services at any time.
We may suspend or terminate access to an account or feature when reasonably necessary because of:
- A material violation of these Terms.
- Fraud, abuse, security threats, or unauthorized activity.
- Legal or regulatory requirements.
- Discontinuation of the Services or a feature.
Termination does not eliminate obligations or rights that arose before termination, including payment, fulfillment, refund, privacy, intellectual-property, limitation-of-liability, dispute, and recordkeeping provisions that by their nature should survive.
We will not use termination to avoid a valid customer remedy or mandatory legal obligation.
24. Disclaimer of Warranties
To the fullest extent permitted by law, the website, account features, and other digital portions of the Services are provided on an “as available” basis. We do not promise that the website will always be uninterrupted, error-free, secure, or compatible with every device.
Products are subject to the descriptions, express warranties, and remedies stated on the product page, packaging, or applicable policy. Except for express promises and warranties that cannot legally be excluded, we disclaim additional warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Some jurisdictions do not allow the exclusion of certain implied warranties, so part or all of this disclaimer may not apply to you. Nothing in these Terms limits a warranty, conformity right, product-liability rule, or other consumer protection that cannot legally be waived.
25. Limitation of Liability
To the fullest extent permitted by law, Travel Space and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, data, goodwill, or business opportunity, arising from the Services or a product, even if advised that such damages were possible.
To the fullest extent permitted by law, our aggregate liability arising from or relating to a particular product order will not exceed the amount you paid to Travel Space for the affected order. For a claim relating only to use of the website and not to a purchase, aggregate liability will not exceed US$100.
These limitations do not apply to the extent liability results from:
- Fraud or fraudulent misrepresentation.
- Willful misconduct or gross negligence where it cannot be limited.
- Death or personal injury to the extent caused by liability that cannot be excluded.
- A violation of privacy, intellectual-property, payment, product-safety, warranty, or consumer rights that cannot legally be limited.
- Any other matter for which applicable law prohibits exclusion or limitation.
Some jurisdictions do not allow certain exclusions or limitations, so they may not apply to you. In those jurisdictions, liability is limited only to the maximum extent permitted by law.
26. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Travel Space and its owners, officers, employees, contractors, and agents from third-party claims, losses, liabilities, and reasonable costs arising directly from:
- Your intentional or unlawful misuse of the Services.
- Your material violation of these Terms.
- User Content that you submit and that infringes another person’s rights.
- Fraudulent or unauthorized conduct attributable to you.
This obligation does not apply to the extent a claim was caused by Travel Space’s negligence, misconduct, legal violation, product defect, or other responsibility that cannot be shifted by contract. We will provide reasonable notice of an indemnified claim and will not settle it in a way that imposes a non-monetary obligation on you without your consent.
27. Events Beyond Reasonable Control
Neither party is liable for a delay or failure caused by an event beyond that party’s reasonable control, such as a natural disaster, severe weather, epidemic, war, terrorism, civil disorder, labor disruption, transportation interruption, government action, utility or network failure, or carrier shutdown.
The affected party must make reasonable efforts to reduce the impact and resume performance. This section does not excuse payment already due, permit us to keep payment for merchandise we will not ship, or eliminate a cancellation, notice, or refund right required by law.
28. Governing Law
Except where the law of your place of residence or another mandatory law requires otherwise, these Terms and disputes arising from them are governed by the laws of the State of Ohio, without regard to conflict-of-law principles.
This choice of law does not deprive a consumer of non-waivable protections provided by the law that would otherwise apply.
29. Informal Dispute Resolution
Before filing a lawsuit concerning the Services or an order, you and Travel Space agree to make a good-faith effort to resolve the dispute informally, except when urgent injunctive relief, a statutory deadline, a chargeback, a government complaint, or another protected remedy makes prior informal resolution impractical or cannot lawfully be conditioned.
To begin the process, send a written notice to support@travelspace.shop with the subject line “Legal Dispute Notice” and include:
- Your name and contact information.
- The order number, if applicable.
- A clear description of the dispute.
- The facts and documents you believe are relevant.
- The specific resolution requested.
Travel Space may send a dispute notice to the email or mailing address associated with your order or account.
The parties will have 30 calendar days after receipt of a complete notice to attempt an informal resolution. This process does not prevent either party from seeking temporary or emergency relief, pursuing an eligible small-claims matter, reporting conduct to a regulator, or exercising a right that cannot be delayed or waived.
30. Courts and Venue
If a dispute is not resolved informally, either party may bring the claim in a court of competent jurisdiction.
Subject to any non-waivable right to file elsewhere, you and Travel Space consent to personal jurisdiction and venue in the state or federal courts located in the State of Ohio.
Either party may bring an eligible individual claim in small-claims court. Nothing in these Terms requires mandatory arbitration or prohibits participation in a class or representative proceeding when such participation is allowed by applicable law.
31. Mandatory Consumer Rights
These Terms do not exclude, restrict, or waive any consumer right, warranty, remedy, statutory limitation, regulatory complaint process, payment-dispute right, or protection that cannot legally be excluded or limited.
If a provision conflicts with mandatory law, the mandatory law controls and the provision will be interpreted or limited only as necessary. The remaining provisions continue in effect.
32. Assignment
You may not transfer your rights or obligations under these Terms without our written consent, except where applicable law permits otherwise.
We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or transfer of the Travel Space business, provided that the assignment does not eliminate rights already earned by customers or protections that cannot legally be reduced.
33. Severability
If a court finds a provision of these Terms invalid or unenforceable, that provision will be enforced to the maximum extent permitted or severed if necessary. The remaining provisions will continue in effect.
34. No Waiver
A failure or delay in enforcing a provision is not a waiver of that provision or any other right. A waiver is effective only when made in writing by an authorized representative and applies only to the specific circumstance stated.
35. Entire Agreement and Order of Precedence
These Terms, the incorporated policies, and any product-specific or promotion-specific terms displayed and accepted before purchase constitute the agreement between you and Travel Space concerning the Services and purchases made through them.
They replace prior or contemporaneous communications on the same subject, except for an express written commitment made by an authorized Travel Space representative that applicable law requires us to honor.
If documents conflict, the following order generally applies:
- Mandatory law.
- Product-specific or promotion-specific terms disclosed before purchase.
- The Refund and Return Policy, Shipping Policy, or Privacy Policy for its specific subject.
- These Terms.
36. No Third-Party Beneficiaries
Except where these Terms expressly state otherwise, they do not create enforceable rights for a person who is not a party to them.
